These Terms of Service (“Terms”) constitute a legally binding agreement between you and PokéPrice. Please read them carefully. By accessing or using this platform you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
By creating an account, accessing, or using PokéPrice(the “Service”, “Platform”, “we”, “us”, or “our”), you (“User”, “you”) agree to be bound by these Terms. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to all of these Terms, you must not access or use the Service.
You must be at least 18 years of age to create an account. By registering, you represent and warrant that you are at least 18 years old and that all information you provide is accurate, current, and complete.
PokéPrice is a technology platform and marketplace intermediary only. We provide tools that allow collectors and vendors of Pokémon trading cards and related collectibles to discover each other, display inventory, and facilitate introductions for potential trades and sales. We are not a buyer, seller, broker, auctioneer, or dealer of any cards or collectibles.
We are not a party to any transaction between users. When a trade or sale occurs between two users of this platform, that transaction is exclusively between those users. PokéPrice does not take title, possession, or custody of any item, and does not collect payment on behalf of any user in connection with a transaction between users.
PokéPrice does not verify, inspect, grade, or authenticate any item listed on the platform. We do not guarantee the accuracy of any listing description, card grade, PSA or other third-party grading score, price, or any other information posted by a user. You acknowledge and agree that you transact with other users entirely at your own risk.
PokéPrice is expressly not liable for any dispute, loss, damage, harm, fraud, misrepresentation, breach of contract, or any other claim arising out of or in connection with any transaction, trade, sale, or other dealing between users of the platform, whether or not such dealing was facilitated through the Service.

Users are encouraged to exercise caution, conduct due diligence, and use secure payment methods with buyer protections when completing any transaction. PokéPrice strongly recommends meeting in safe, public locations for in-person transactions, using reputable escrow or payment services, and independently verifying the grade and authenticity of any card before purchase.
By using this platform, you release PokéPrice and its officers, directors, employees, agents, and successors from any and all claims, demands, damages, losses, liabilities, and causes of action of every kind, known and unknown, arising out of or relating to any dispute between users or any transaction conducted through introductions made on the platform.
To use the Service, you must register for an account by providing a valid email address and verifying it via the confirmation link we send. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@pokeprice.app if you suspect any unauthorized access to or use of your account. You agree not to share your login credentials with any third party. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
We reserve the right to terminate or suspend accounts that appear to be shared, compromised, or used in violation of these Terms.
The platform supports two user roles:
All users in both roles agree that by making their profile, trade binder, wants list, or listings public, they grant other platform users the ability to view that information for the purpose of facilitating transactions. Public profile information may be indexed by search engines.
You agree that you will not use the Service to:
Violation of these prohibitions may result in immediate account suspension or termination and, where applicable, referral to appropriate law enforcement authorities.
You are solely responsible for all content you upload, post, or otherwise submit to the Service, including but not limited to listing descriptions, card details, prices, profile information, and social contact links (“User Content”).
By submitting User Content, you represent and warrant that: (a) you own or have all necessary rights to the content; (b) the content is accurate and not misleading; (c) the content does not infringe any third-party intellectual property, privacy, or other rights; and (d) the content complies with these Terms and all applicable laws.
You grant PokéPrice a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit your User Content solely for the purpose of operating and providing the Service. This license terminates when you delete the content or close your account, subject to reasonable technical delays and backup retention.
The Service and its original content, features, functionality, design, and code are and remain the exclusive property of PokéPrice and its licensors. Our trademarks, service marks, and trade names may not be used in connection with any product or service without our prior written consent.
Pokémon, all Pokémon card names, set names, and associated imagery are trademarks and intellectual property of Nintendo, Creatures Inc., and GAME FREAK inc. (collectively, “The Pokémon Company”).PokéPrice is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Creatures Inc., or GAME FREAK inc. Card images displayed on the platform are used pursuant to applicable fair use principles for the purpose of identification and price reference.
PSA, BGS, CGC, and other grading company names are trademarks of their respective owners.PokéPrice is not affiliated with any grading company.
Certain features of the Service may require a paid subscription. Paid plans are billed on a recurring basis (monthly or annually, as selected) via our payment processor, Stripe. Your subscription will automatically renew at the end of each billing period unless you cancel through your account settings before the renewal date. You will receive an advance email reminder before each renewal.
Cancellation takes effect at the end of the current paid billing period; you will retain access to paid features until that date. We offer no-questions-asked pro-rated refunds within the current billing period upon request directed to support@pokeprice.app. All fees are stated in US dollars and are exclusive of applicable taxes. You are responsible for any sales, use, GST, VAT, or other taxes applicable to your subscription.
We reserve the right to modify our pricing with 30 days' advance notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY CONTENT ON THE SERVICE, INCLUDING PRICING DATA, MARKET VALUATIONS, OR USER-GENERATED LISTINGS. PRICE DATA PROVIDED IS FOR REFERENCE ONLY AND DOES NOT CONSTITUTE FINANCIAL OR INVESTMENT ADVICE. CARD VALUES ARE VOLATILE AND PAST PRICING DATA IS NOT INDICATIVE OF FUTURE VALUE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POKÉPRICE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF CARDS OR COLLECTIBLES, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the fullest extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless PokéPrice and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, judgments, awards, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) any transaction or dispute between you and another user; (d) your violation of these Terms; or (e) your violation of any third-party right, including any intellectual property right or privacy right.
Informal Resolution. Before initiating any formal dispute, you agree to first contact us at support@pokeprice.app and attempt to resolve the dispute informally. We will try to resolve the matter within 30 days of receiving your notice.
Binding Arbitration.If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (other than claims for injunctive or other equitable relief) shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. YOU AND POKÉPRICE EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
This arbitration clause does not apply to users located in the European Union, where applicable EU consumer protection laws may govern dispute resolution.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict-of-law provisions. For users in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence may also apply and are not excluded by these Terms.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.
We process personal data in compliance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), the UK GDPR, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and other applicable privacy laws. To exercise any of these rights, please contact us at support@pokeprice.app. We will respond to verified requests within 30 days (extendable by an additional 60 days for complex requests, with prior notice). We process personal data on the following lawful bases: performance of contract (to provide the Service), compliance with legal obligations, and legitimate interests (security, fraud prevention, service improvement).
If you are a California resident, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) grants you specific rights regarding your personal information:
To submit a CCPA/CPRA request, please contact us at support@pokeprice.app with the subject line “California Privacy Request.” We will verify your identity and respond within 45 days. We may extend this period by an additional 45 days with notice. You may designate an authorized agent to make a request on your behalf.
You may deactivate your account at any time from your account settings. Upon deactivation, your public listings and profile will be immediately hidden. Your personal data and inventory records will be anonymized within 30 days, except where retention is required by law, for fraud prevention purposes, or to resolve outstanding disputes.
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or if your account has been inactive for more than 24 consecutive months. We will make reasonable efforts to notify you via the email address on file before terminating an account for inactivity.
Sections 3 (No Liability for User Transactions), 8 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), 13 (Dispute Resolution), 14 (Governing Law), and any other provisions that by their nature should survive, shall survive termination of these Terms.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email at least 14 days before the changes take effect and will require your re-acceptance within the Service before you may continue using it. For non-material changes (such as typographic corrections or clarifications), we will update the “Last updated” date and post the revised Terms. Your continued use of the Service after material changes take effect constitutes acceptance of the new Terms.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and PokéPrice with respect to the Service and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure. We will not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
